Trang 84 - The principle seems to us to be, that in contracts in which the performance depends on the continued existence of a given person or thing, a condition is implied that the impossibility of performance, arising from the perishing of the person or thing, shall excuse the performance.
Trang 337 - II The International Commission shall be composed of five members, to be appointed as follows : One member shall be chosen from each country, by the Government thereof ; one member shall be chosen by each Government from some third country : the fifth member shall be chosen by common agreement between the two Governments, It being understood that he shall not be a citizen of either country.
Trang 84 - There seems no doubt that where there is a positive contract to do a thing, not in itself unlawful, the contractor must perform it or pay damages for not doing it, although in consequence of unforeseen accidents, the performance of his contract has become unexpectedly burthensome or even impossible.

Trang 338 - ... extend the time by mutual agreement. The report shall be prepared in triplicate; one copy shall be presented to each government and the third retained by the commission for its files. , The high contracting parties reserve the right to act independently on the subject matter of the dispute after the report of the commission shall have been submitted.
Trang 334 - Differences which may arise of a legal nature, or relating to the interpretation of Treaties existing between the two Contracting Parties, and which it may not have been possible to settle by diplomacy...
Trang 188 - It is claimed that martial law covers with its broad mantle the proceedings of this military commission. The proposition is this: that in a time of war the commander of an armed force (if in his opinion the exigencies of the country demand it, and of which he is to judge), has the power, within the lines of his military district, to suspend all civil rights and their remedies, and subject citizens as well as soldiers to the rule of his will; and in the exercise of his lawful authority cannot be restrained,...
